As an associate at the Texas law firm of Shellist|Lazarz|Slobin, Dwain G. Capodice focuses his law practice on employment law civil litigation in state and federal courts and in administrative proceedings. Mr. Capodice has handled a number of cases-across the State of Texas successfully representing numerous employees against their current and/or former employers. Mr. Capodice represents clients in matters involving Title VII of the Civil Rights Act, Chapter 451 of the Texas Labor Code (workers' compensation retaliation), the Age Discrimination in Employment Act, the Fair Labor Standards Act, the Family and Medical Leave Act, the Texas Commission on Human Rights Act, the Texas Payday Act, the Uniformed Services Employment and Reemployment Rights Act, and the Americans with Disabilities Act.

Mr. Capodice also provides advice to clients regarding severance agreements, covenants not to compete, non-solicitation agreements, and confidentiality agreements. He also provides advice regarding numerous state law claims including breach of contract, quantum meruit claims, and defamation. In addition, he represents clients before administrative agencies including the Equal Employment Opportunity Commission, the Department of Labor, and the Texas Workforce Commission - Civil Rights Division. He also serves as a consultant to local and regional companies, advising them on such matters as wage and hour issues, non-competition agreements, confidentiality agreements, employee handbooks, and sexual harassment issues.

A graduate of the University of Texas and the University of Houston Law Center, Mr. Capodice is admitted to practice before the United States District Courts for the Southern District of Texas, and all Texas state courts. He is a member of the Litigation and Labor and Employment Law Sections of the State Bar of Texas. He has presented seminars on employment law fundamentals for HR professionals and has published articles on workplace harassment and risk management in the workplace.
